Theodyx Inc. (“Theodyx,” “we,” “us,” or “our”) respects the intellectual property rights of others, and we ask everyone who uses the Site and our services to do the same. This DMCA & Copyright Policy explains how copyright owners (or their authorized agents) can notify us about material they believe infringes their copyright, how someone whose material was removed can respond, and how we handle repeat infringers. It works alongside our Terms & Conditions and Privacy Policy.
This policy follows the notice-and-takedown procedures of the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
Our Commitment to Intellectual Property
We take copyright seriously. If you submit content to Theodyx — including media you upload through our Our Scouting application, such as a media kit, photos, sample images, or links to your work — you should only submit material that you own or that you otherwise have the right to share with us. Do not upload or send us anyone else’s copyrighted work without permission.
When we receive a complete and valid notice that material on the Site infringes a copyright, we will act on it. We may remove or disable access to the material that is claimed to be infringing, and we may take other steps we consider appropriate.
Repeat Infringers
Theodyx has adopted a policy of terminating, in appropriate circumstances and at our discretion, the accounts or access of users who are determined to be repeat infringers of copyright. We may also limit access to the Site or our services for anyone who infringes the intellectual property rights of others, whether or not there is a repeat offense.

How to File a Copyright Infringement Notice
If you believe that your copyrighted work has been copied and is accessible on the Site in a way that constitutes copyright infringement, you may send a written notification to our Designated Copyright Agent at the address above. To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially all of the following:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of those works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or to which access is to be disabled, along with information reasonably sufficient to let us locate the material (for example, the URL or a clear description of where it appears).
- Information reasonably sufficient to let us contact you, such as your name, mailing address, telephone number, and, if available, an email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and — under penalty of perjury — that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages. If you are not sure whether the material is protected by copyright law or whether your use is authorized, you may wish to consult an attorney before sending a notice.
Counter-Notification
If you believe that material you posted or submitted was removed or disabled by mistake or misidentification, you may send a written counter-notification to our Designated Copyright Agent at the address above. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include substantially all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Theodyx may be found), and that you will accept service of process from the person who provided the original notification of claimed infringement or an agent of that person.
After we receive a valid counter-notification, we may forward it to the party who submitted the original takedown notice. If that party does not notify us within ten (10) business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may, in our discretion, restore the removed material or cease disabling access to it. As with takedown notices, under 17 U.S.C. § 512(f) any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable for damages.
Changes to This Policy
