Welcome to Theodyx. These Terms & Conditions (the “Terms”) are a binding agreement between you and Theodyx Inc., a Delaware corporation (“Theodyx,” “we,” “us,” or “our”), and they govern your access to and use of our websites at www.theodyx.com and our related domains (theodyx.net, theodyx.store, theodyx.xyz, theodyx.me, and theodyx.info), together with the “Our Scouting” creator-application flow and any other features, content, or services we offer (collectively, the “Services” or the “Site”). Theodyx is a media, talent-management, and technology & ventures company in the creator economy — Media That Moves. Intelligence That Matters.

Please read these Terms carefully. They include a binding individual arbitration agreement, a class-action waiver, and a limitation of liability that affect your legal rights. They also include a carve-out for certain sexual-assault and sexual-harassment claims, a 30-day right to opt out of arbitration, and other important provisions. Nothing in these Terms waives any right that cannot be waived under applicable law.

1. Acceptance of these Terms

By accessing or using the Services — including by browsing the Site, by clicking a box or button indicating your acceptance, or by submitting an application through Our Scouting — you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Services.

If you are under the age of 18, you may use the Services and apply through Our Scouting only with the knowledge and involvement of a parent or legal guardian. We ask that a parent or guardian review these Terms and the Privacy Policy with you and co-agree to them on your behalf. By allowing a minor to use the Services or submit an application, a parent or guardian agrees to these Terms for themselves and for the minor.

2. Definitions

  • “Services” means the Site, the Our Scouting application flow, and all related features, content, tools, and communications that we provide.
  • “You” or “user” means the individual accessing or using the Services, and, where the individual is a minor, also that individual’s parent or legal guardian.
  • “Applicant” means a person who submits an application through Our Scouting.
  • “User Content” means any information, text, links, photographs, images, media kits, files, or other materials you submit, upload, or transmit through the Services.
  • “Affiliate” means any entity that controls, is controlled by, or is under common control with Theodyx.

3. Eligibility

The Services are offered for use in the United States and are intended for a general audience there. To use the Services and to apply through Our Scouting, you must be at least 14 years old. We do not knowingly permit children under 13 to use the Services or submit an application, consistent with the U.S. Children’s Online Privacy Protection Act (COPPA).

Age is enforced on the server: the date of birth you provide is re-derived server-side, not merely checked as a box, and applications that do not meet the minimum age are blocked. If you are between 14 and 17, you represent that a parent or legal guardian has reviewed and agreed to these Terms with you. You also represent that the information you provide is accurate and that your use of the Services does not violate any law that applies to you.

4. Our Scouting Applications

Our Scouting lets creators apply to be considered for possible representation or collaboration with Theodyx. Submitting an application is not an offer, a contract, an acceptance, a promise, or any guarantee of representation, employment, compensation, response, or any particular outcome. Whether to extend any opportunity is entirely within Theodyx’s discretion. Any future relationship would be set out in a separate written agreement signed by both parties. Nothing here makes Theodyx a licensed talent agency, and nothing here creates an agency, partnership, employment, or joint-venture relationship.

When you apply, you provide information directly to us — such as your name, email, date of birth, location, primary platform and social handles, your best links, optional notes, and uploaded media (for example, a media-kit PDF and a few sample images). How we handle that information is described in our Privacy Policy.

Your safety matters to us. Please remember our scouting practices:

  • Theodyx will contact applicants only from official @theodyx email addresses.
  • Theodyx never charges a fee to apply and never asks for payment or financial information as part of scouting.
  • Theodyx never requests nude, lingerie, or otherwise sexualized or inappropriate photos.

If anyone contacts you claiming to be from Theodyx and does any of these things, it is not us. Please report suspected impersonation to scouting@theodyx.com. You can read more in our safety notice.

5. User Content & License

You keep ownership of your User Content. We do not claim ownership of your applications, media kits, photos, links, or other materials. By submitting User Content, you grant Theodyx and its Affiliates and service providers a non-exclusive, royalty-free, worldwide license to host, store, reproduce, process, and display that User Content solely for the limited purposes of operating the Services, reviewing and evaluating your application, and communicating with you about it. This license exists only to let us run and assess the Services; it ends when we no longer need your User Content for those purposes, except for copies kept in routine backups or as required by law.

You represent that you have the rights necessary to submit your User Content and to grant this license, and that your User Content does not infringe anyone’s rights or violate any law. You are responsible for the User Content you submit. Where your User Content includes images of a minor, those are treated as sensitive information and given heightened protection, as described in our Privacy Policy.

6. Intellectual Property

The Services — including the Site’s design, text, graphics, logos, the Theodyx name and marks, and all related software and content (other than User Content) — are owned by Theodyx or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. You may not copy, modify, distribute, sell, frame, scrape, or create derivative works from the Services except as expressly permitted. All rights not expressly granted are reserved.

7. Acceptable Use

You agree not to misuse the Services. Among other things, you agree not to:

  • Provide false, misleading, or impersonating information, or apply on behalf of someone else without authority;
  • Upload content that is unlawful, infringing, defamatory, harassing, or sexually explicit, or that depicts a minor in a sexualized way;
  • Attempt to circumvent age verification, security measures, the web-application firewall, bot protection, rate limiting, or the Turnstile challenge;
  • Introduce malware, attempt to gain unauthorized access, probe or scan the Services, or interfere with their operation;
  • Scrape, harvest, or collect data from the Services by automated means without our written permission; or
  • Use the Services in any way that violates applicable law or these Terms.

We may investigate and respond to suspected violations, including by removing content, limiting access, or suspending or terminating use of the Services.

8. Copyright & DMCA

Theodyx respects the intellectual-property rights of others and expects users to do the same. If you believe content on the Services infringes your copyright, you may submit a notice, and affected users may submit a counter-notice, as described in our DMCA Policy. Theodyx maintains a policy of terminating, in appropriate circumstances, the access of users who are repeat infringers.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any application will lead to any particular result. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

10. Limitation of Liability

To the fullest extent permitted by law, Theodyx and its Affiliates, and our and their officers, employees, and service providers, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or relating to the Services or these Terms, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Services will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Theodyx and its Affiliates from third-party claims, losses, and reasonable expenses arising out of your User Content, your use of the Services, or your violation of these Terms or of applicable law. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate. This section does not apply to the extent a claim arises from our own conduct.

12. Informal Dispute Resolution

We want to resolve concerns without formal proceedings. Before starting an arbitration or any other proceeding, you agree to first give us a chance to resolve the dispute. Send a written notice describing the dispute and the relief you seek to contact@theodyx.com, and we will do the same to you. For at least 30 days after notice is sent, the parties will try in good faith to resolve the dispute informally. This informal step is required before either party may begin arbitration; any deadline to bring a claim is paused while the parties work through it.

13. Binding Arbitration

Please read this section carefully — it affects how disputes between you and Theodyx are resolved.

Except for the matters described in the “Exceptions” and the “EFAA Carve-Out” below, you and Theodyx agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, and not in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, as modified by these Terms. This arbitration agreement is governed by the Federal Arbitration Act (FAA). The arbitrator may award the same individual relief that a court could, and the arbitrator’s award may be entered as a judgment in any court of competent jurisdiction.

Delegation

The arbitrator, and not any court, has the exclusive authority to resolve threshold questions of arbitrability — including the existence, scope, validity, enforceability, and interpretation of this arbitration agreement, and any claim that all or part of it is void or voidable. This includes, for example, any contention that a party may disaffirm this agreement on the basis of age or capacity; that question is for the arbitrator to decide.

Class & Representative Action Waiver

You and Theodyx agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of a class or representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim — and only that claim — will be severed and may proceed in court, while all other claims continue in arbitration.

EFAA Carve-Out for Sexual Assault & Sexual Harassment

Consistent with the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2022 (EFAA), if you assert a claim that relates to an alleged sexual assault or sexual harassment dispute, that claim is excluded from mandatory arbitration and from the class and representative action waiver, at your election. You may choose to bring such a claim in court, and the arbitration agreement and waiver above will not apply to that claim to the extent the law so provides.

30-Day Right to Opt Out of Arbitration

You may opt out of this arbitration agreement by sending written notice within 30 days after you first accept these Terms. Send your name and a clear statement that you wish to opt out of arbitration to contact@theodyx.com. Opting out of arbitration will not affect any other part of these Terms, and it will not affect your relationship with Theodyx.

Exceptions

Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to protect intellectual-property rights. Nothing in this section requires arbitration of a claim that, by law, cannot be required to be arbitrated.

14. Time Limit to Bring Claims

To the extent permitted by law, any claim arising out of or relating to the Services or these Terms must be filed within one (1) year after the claim arose; otherwise, the claim is permanently barred. This limitation does not apply to the extent it is prohibited by applicable law, including for any claim that cannot lawfully be shortened in this way.

15. Governing Law

These Terms and any dispute between you and Theodyx are governed by the laws of the State of Delaware, the state of our incorporation, without regard to its conflict-of-laws rules. For any matter that proceeds in arbitration, the Federal Arbitration Act governs the arbitration agreement. This choice of law does not deprive you of the protection of any mandatory consumer-protection rule of the place where you live that cannot be overridden by agreement.

16. Your Non-Waivable Rights

Nothing in these Terms waives, limits, or requires you to give up any right or protection that cannot be waived under applicable law. This includes, without limitation, your rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (see Cal. Civ. Code section 1798.192), and any non-waivable protections that apply to minors. To the extent any provision of these Terms conflicts with such a non-waivable right, that right controls.

17. Changes, Termination & General Terms

Changes to these Terms. We may update these Terms from time to time. When we make material changes, we will update the effective date above and provide notice through the Services or by other reasonable means. Changes apply going forward; your continued use of the Services after changes take effect means you accept the updated Terms. If you do not agree, please stop using the Services.

Suspension & termination. We may suspend or terminate access to the Services, in whole or in part, at any time, including for a violation of these Terms. Provisions that by their nature should survive — such as User Content licenses already granted, intellectual property, disclaimers, limitation of liability, indemnification, arbitration, and governing law — will survive termination.

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Entire agreement. These Terms, together with the Privacy Policy and any policies referenced here, are the entire agreement between you and Theodyx about the Services and supersede prior understandings on that subject.

Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms to an Affiliate or in connection with a merger, acquisition, reorganization, or sale of assets.

Electronic communications. You consent to receive communications from us electronically — such as by email or through the Services — and you agree that electronic communications, agreements, and notices satisfy any legal requirement that they be in writing.

Privacy Policy

This Privacy Policy explains how Theodyx Inc. (“Theodyx,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information. We are a media, talent-management, and technology/ventures company in the creator economy, organized as a Delaware C-Corporation.

This Policy applies to www.theodyx.com and our related sites theodyx.net, theodyx.store, theodyx.xyz, theodyx.me, and theodyx.info (together, the “Site”), and to the “Our Scouting” creator-application flow available at our scouting page. A short, plain-language summary of what we collect and why is available in our Notice at Collection. This Policy works alongside our Terms & Conditions; please also see our Cookie Policy.

Who we are & scope

Theodyx provides a marketing website and a creator-application experience. This Policy covers personal information we handle through the Site and the scouting flow. It does not cover the practices of third parties we do not control. We have written this Policy to meet a high-water mark drawn from the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), and from Virginia-model comprehensive privacy laws, so that we can offer strong, consistent protections to everyone.

Personal information we collect

We collect the following categories of personal information, described using CCPA categories together with the specific, real fields involved. We collect only what we need to operate the Site and to evaluate creator applications.

  • Identifiers. Your first and last name and your email address.
  • Age information. Your date of birth, which we use to confirm eligibility. We re-derive your age on the server (see Notice at Collection and the Minors section below).
  • Geolocation (coarse). The city, state, and country you type into your application. We also derive a coarse, country-level location from your network connection; we do not collect precise GPS location.
  • Internet or other electronic network activity. Cookieless, first-party analytics — such as page views and scroll depth — and a salted hash of your IP address. We never store a raw IP address; we store only a one-way salted hash, together with minimal request metadata, for security and abuse-prevention.
  • Professional or creator information. Your primary platform, your social handles (for example, Instagram, TikTok, YouTube, or other), your “best links” (URLs), and audience or creator details you choose to share.
  • Audio-visual information. Media you upload — a media-kit PDF and up to a few sample images or photos — plus any optional notes you add.
  • Inferences. Limited inferences we may draw from the above to evaluate a possible fit for representation. We do not use these to build advertising or cross-context tracking profiles.

Sources of personal information

We obtain personal information from two sources:

  • Directly from you — the information you type into the scouting application and the media you upload, including your age confirmation (14+) and your consent.
  • Automatically from your device and use of the Site — cookieless analytics signals (page views, scroll depth), the coarse country derived from your connection, and the salted IP hash and minimal request metadata generated by our security tools.

Why we use personal information

We use personal information for the following purposes:

  • To provide and operate the Site — to deliver pages, run the scouting flow, and measure basic, privacy-preserving usage.
  • To evaluate scouting applications — to review submissions and consider whether to reach out about possible representation. Applicant data may be routed into our internal creator-data system for this evaluation.
  • To communicate with you — to respond to applications, questions, and requests. We contact applicants only from official @theodyx email addresses.
  • For security and fraud-prevention — to protect the Site against abuse, bots, and unauthorized access, using tools such as a privacy-preserving CAPTCHA-alternative, a web-application firewall, rate limiting, and a privacy-safe audit log of salted hashes.
  • To comply with law — to meet legal obligations and to establish, exercise, or defend legal claims.

Sensitive personal information

Photos and full-length images of minors are treated as sensitive personal information. We use sensitive personal information only for limited, permitted purposes — to provide the service, to evaluate applications, and for security — and never to infer characteristics about a person and never for advertising. You may ask us to limit the use of your sensitive personal information; see Limit the Use of My Sensitive Personal Information. Because we restrict sensitive personal information to these permitted purposes, the right to limit has, in practice, little additional effect, but we honor every request.

How we disclose personal information

We do not sell your personal information. We disclose it only as follows:

  • To service providers and processors — including our cloud hosting, security, and storage provider, our website platform, and our email provider — under contracts that limit them to performing services for Theodyx and that prohibit using the information for their own purposes.
  • To affiliates under common control with Theodyx.
  • For legal and safety reasons — to comply with law, respond to lawful requests, enforce our Terms & Conditions, and protect the rights, safety, and security of applicants, the public, and Theodyx.
  • In a corporate transaction — in connection with a merger, financing, acquisition, or sale of assets, subject to appropriate protections.

We do not sell or share your personal information

Theodyx does not “sell” personal information and does not “share” it for cross-context behavioral advertising, as those terms are defined under the CCPA. We do not use third-party advertising cookies or ad pixels, and we do not engage in cross-site or cross-context tracking, nor do we work with data brokers.

We honor Global Privacy Control (GPC) browser signals as a valid opt-out preference signal. Because we do not sell or share personal information, a GPC signal does not change how your information is handled, but we recognize and respect it. You may also use Do Not Sell or Share My Personal Information to record your preference.

Minors

You must be at least 14 years old to apply through the scouting flow, and this minimum is enforced on the server (your date of birth is re-derived on the server, not merely accepted as a checkbox). We block applicants under 13 entirely, consistent with a conservative reading of the Children’s Online Privacy Protection Act (COPPA).

We do not sell or share the personal information of consumers we know to be under 16 years of age without the affirmative authorization (opt-in) required by California Civil Code section 1798.120(c). Because we do not sell or share personal information at all, no such authorization is sought.

A parent or guardian may contact us to exercise rights on behalf of an eligible minor, including to access, correct, or delete the minor’s information. Please email contact@theodyx.com. To report impersonation or a safety concern involving a minor, contact scouting@theodyx.com and see our Safety information.

Retention

We keep personal information only for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. We determine retention based on criteria such as: how long we need the information to evaluate an application and any resulting relationship; whether you ask us to delete it; and our legal, security, and recordkeeping obligations.

Telemetry is minimized and automatically purged on a schedule. Our security audit log stores only salted hashes — never a raw IP address, user-agent string, or email — and is similarly retained only as long as needed for abuse-prevention.

Your rights

Depending on where you live and applicable law, you may have the following rights (drawn from the California and Virginia-model frameworks):

  • Know and access — to learn what personal information we collect, use, and disclose, and to obtain a copy.
  • Delete — to ask us to delete personal information we hold about you.
  • Correct — to ask us to correct inaccurate personal information.
  • Data portability — to receive your information in a portable, readily usable format where applicable.
  • Opt out of sale or sharing, and of targeted advertising and certain profiling — though, as explained above, we do none of these.
  • Limit the use of sensitive personal information — see Limit the Use of My Sensitive Personal Information.
  • Non-discrimination and no retaliation — we will not discriminate or retaliate against you for exercising any of these rights.
  • Appeal — if we deny your request, you may appeal our decision (Virginia-model). We will respond to your appeal within the time the law allows and explain our reasoning.

How to exercise your rights

To make a request, email contact@theodyx.com. We will take reasonable steps to verify your identity before acting, which may include confirming information you previously provided. You may use an authorized agent to submit a request on your behalf; we may ask the agent for proof of authorization and may ask you to verify your identity directly. We aim to respond within the timelines required by applicable law, and we will let you know if we need additional time. We also honor Global Privacy Control (GPC) signals as described above.

Cookies

We use a cookieless, first-party approach to analytics. We do not use advertising cookies or third-party ad pixels. For details on the limited, privacy-preserving technologies we use — including a per-tab session token stored in your browser’s sessionStorage (not a cookie) that is cleared when you close the tab — please see our Cookie Policy.

Data security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These include one-way salted hashing of IP addresses, encryption of data in transit, access controls, and abuse-prevention tooling such as a privacy-preserving CAPTCHA-alternative and a web-application firewall. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security; we encourage you to share only what you are comfortable providing.

International

Theodyx is based in the United States, and we process and store personal information in the United States. Our launch is US-only. We do not currently target or monitor individuals in the European Union, the United Kingdom, Canada, Brazil, or China, and the corresponding regional privacy modules are dormant. If that changes, additional regional rights and representative arrangements would apply, and we would update this Policy accordingly.

Changes to this Policy & how to contact us

We may update this Policy from time to time. When we do, we will revise the effective date shown with this Policy and, where appropriate, provide additional notice. Your continued use of the Site after an update means you accept the revised Policy.

This Notice at Collection summarizes, at or before the point of collection, the categories of personal information Theodyx Inc. (“Theodyx,” “we,” “us”) collects, why we collect it, and your choices. For the complete picture, please read our full Privacy Policy.

What we collect

Depending on how you use the Site and whether you submit a creator application through Our Scouting, we may collect the following categories of personal information:

  • Identifiers — such as your first and last name and email address.
  • Age & date of birth — collected to confirm you meet our minimum age requirement.
  • Coarse location — the city, state, and country you provide.
  • Internet & usage information — privacy-preserving, cookieless analytics (page views and scroll depth), plus minimal request metadata and a salted hash of your IP address (we never store your raw IP).
  • Professional & creator information — your primary platform, social handles, links, and any notes you choose to share.

Some images of minors are treated as sensitive personal information. We apply heightened protections to this information, including restricted access and data minimization.

Why we collect it

We use these categories of personal information to operate and secure the Site; to evaluate scouting applications and consider possible representation; to communicate with you; to protect against fraud, abuse, and security threats; and to comply with our legal obligations.

No sale or sharing

Theodyx does not sell your personal information and does not “share” it for cross-context behavioral advertising, as those terms are defined under California law. We do not use sensitive personal information to infer characteristics about you or for advertising. To learn more, see Do Not Sell or Share My Personal Information.

How long we keep it

We retain personal information only for as long as needed for the purposes described above or as required by law. Usage telemetry is minimized and automatically purged on a routine basis.

Cookie Policy

Effective date: June 26, 2026

This Cookie & Tracking-Technologies Policy explains the small number of technologies we use across our websites at www.theodyx.com and our related domains (together, the “Site”), and the ones we deliberately do not use. Theodyx is built to be privacy-first and largely cookieless, and this policy is meant to describe that approach plainly. It works alongside our Privacy Policy, which describes how we handle personal information more generally.

A quick word on what these technologies are

“Cookies” are small text files a website can store in your browser. “Local storage” and “session storage” are related browser features that let a site keep small pieces of information on your device. “Similar technologies” can include things like pixels, tags, and software development kits. Many sites use these tools to recognize you across visits, build advertising profiles, or follow you from one site to another. That is not how we operate.

Our approach: no ad tracking, no cross-site tracking

We want to be clear about what we avoid by design:

  • We do not use advertising, marketing, or retargeting cookies.
  • We do not use cross-site or cross-context tracking technologies.
  • We do not allow third-party advertising pixels or trackers on the Site.
  • We do not share information with data brokers, and we do not sell your personal information.

Because of this, you will not see a typical advertising cookie banner on our Site, since there are no advertising or cross-context tracking cookies to consent to.

What we actually use

We rely on two narrow categories of technology: strictly necessary (essential) technologies that keep the Site working and secure, and a single cookieless, first-party analytics signal that helps us understand site usage in aggregate. The lists below describe each one.

Essential (strictly necessary)

  • Purpose: To deliver the Site securely and reliably, protect against abuse and fraud, and support core functions such as our creator-application flow at /scouting. These technologies are required for the Site to operate and are not used for advertising.
  • Examples: A privacy-preserving anti-abuse check (Cloudflare Turnstile) used in place of a traditional CAPTCHA; security, bot-protection, web-application-firewall, and content-delivery protections that may set short-lived technical tokens to verify requests and keep the Site available.
  • Can you turn these off? Because they are necessary for security and basic operation, they are not optional while you use the Site; we keep them minimal and limited to these purposes.

Analytics (cookieless, first-party)

  • Purpose: To understand how the Site is used in aggregate — for example, which pages are viewed and how far visitors scroll — so we can improve content and layout. This is first-party only and is not used to advertise to you or to track you across other sites.
  • How it works: We use a per-tab token stored in your browser’s sessionStorage. This is not a cookie. It exists only for the current browser tab and is cleared automatically when you close that tab, so it does not follow you between visits or across sites. It powers a lightweight, privacy-preserving usage beacon.
  • What it is not: No advertising cookies, no third-party ad pixels, no cross-site or cross-context tracking, and no data brokers are involved.

We honor Global Privacy Control (GPC)

We honor the Global Privacy Control (GPC) signal. If your browser or extension sends a GPC signal, we treat it as a valid request not to sell or share your personal information — which aligns with how we already operate, since we do not sell or share personal information for cross-context behavioral advertising. How you stay in control

You have several straightforward ways to manage these technologies:

  • Browser settings: Most browsers let you block or limit cookies, local storage, and session storage, and to review or clear what a site has stored.
  • Clear site data: You can clear the Site’s stored data (including any session token) at any time through your browser’s privacy or site-settings controls; closing the browser tab already clears our per-tab analytics token.
  • Enable GPC: You can turn on a Global Privacy Control signal in a supported browser or extension, and we will honor it.
  • Decline non-essential where offered: Where we offer a choice for any non-essential technology, you can decline it. Note that essential, strictly necessary technologies cannot be switched off while you use the Site, because the Site needs them to function and stay secure.

Changes to this policy

We may update this Cookie & Tracking-Technologies Policy from time to time to reflect changes in our practices or for legal and operational reasons. When we make material changes, we will update the effective date shown above and post the revised version on the Site.

It serves both the “Do Not Sell or Share My Personal Information” choice and the “Limit the Use of My Sensitive Personal Information” choice. It explains how Theodyx Inc. (“Theodyx,” “we,” “us”) treats your personal information and how you can exercise these choices. For the full picture of how we handle personal information, please read our Privacy Policy.

Do Not Sell or Share My Personal Information

Theodyx does not “sell” your personal information for money or other valuable consideration, and we do not “share” it for cross-context behavioral advertising, as the California Consumer Privacy Act (as amended by the CPRA) defines those terms. We do not exchange personal information with data brokers, and we do not allow third parties to use it to target advertising to you across other sites or services.

Because we do not engage in that kind of selling or sharing, there is, in practical terms, nothing of that nature for you to opt out of. We nonetheless honor opt-out requests, and we want you to be able to record your preference clearly. We also recognize a Global Privacy Control (GPC) signal sent by your browser or a browser extension as a valid request to opt out of any sale or sharing of personal information from that browser. If you would like to submit an opt-out request directly, you may do so using the steps under How to Submit a Request below.

Limit the Use of My Sensitive Personal Information

Some of the information we collect through the scouting application — for example, photos and full-length images, precise account identifiers, and information about minors — may qualify as sensitive personal information. We already limit our use of this information to the purposes the law permits without a further opt-out, and only to what is reasonably necessary to:

  • provide and operate the Service and our scouting application;
  • review and evaluate applications and consider possible representation; and
  • keep the Service secure and prevent fraud and abuse.

We do not use sensitive personal information to infer characteristics about you, and we do not use it for advertising or for any purpose that would require offering a “Limit the Use of My Sensitive Personal Information” choice under California law. You may still ask us to confirm this and to limit our use of your sensitive personal information to these permitted purposes, and we will honor that request.

Minors

The personal information of applicants who are minors is never sold and never shared, and photos and full-length images of minors are treated as sensitive personal information. Access to this information is restricted, and we minimize what we collect and retain. You can read more about how we protect minors in our Privacy Policy.

How to Submit a Request

To exercise either choice on this page — to opt out of any sale or sharing, or to ask us to limit the use of sensitive personal information — email us at contact@theodyx.com and tell us what you are requesting. It helps if you include the email address and any social handles you used in your application so we can locate your information.

How we verify your request. To protect your privacy and security, we take reasonable steps to verify your identity before acting on a request, usually by matching the details you provide against the information already in our records and by corresponding with you at the email address associated with your application. We may ask for additional information if we cannot verify you from what you have given us. We use information provided in a request only to verify and respond to it.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We may ask the agent for proof that you gave them permission to act for you, and we may still ask you to verify your own identity directly with us.

No discrimination or retaliation. We will not discriminate or retaliate against you for exercising any of these privacy choices. Exercising a choice will not affect how your scouting application is evaluated, and you will receive the same quality of service.

Theodyx Inc. (“Theodyx,” “we,” “us,” or “our”) respects the intellectual property rights of others, and we ask everyone who uses the Site and our services to do the same. Our Commitment to Intellectual Property

Repeat Infringers

Theodyx has adopted a policy of terminating, in appropriate circumstances and at our discretion, the accounts or access of users who are determined to be repeat infringers of copyright. How to File a Copyright Infringement Notice

If you believe that your copyrighted work has been copied and is accessible on the Site in a way that constitutes copyright infringement, you may send a written notification to our Designated Copyright Agent at the address above. To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially all of the following:

Theodyx Inc. (“Theodyx,” “we,” “us,” or “our”) is committed to making our websites and our “Our Scouting” creator-application flow usable by as many people as possible, including people who rely on assistive technologies. We believe that everyone should be able to learn about Theodyx and apply to be scouted, regardless of ability, and we treat accessibility as an ongoing part of how we build and maintain the Site.

This statement explains the standard we aim for, the measures we take, the limitations we are still working through, and how you can reach us if something does not work for you.

Our commitment

Accessibility is not a one-time project for us. We work to improve the experience of our digital properties on a continuing basis, and we factor accessibility into the design, build, and review of new pages and features — including the scouting application — rather than treating it as an afterthought.

Conformance target

We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA, which is a widely recognized standard for making web content more accessible to people with a broad range of disabilities. We are also working toward the more recent WCAG 2.2 Level AA success criteria as we update our pages and components.

“Aim to conform” means we use these guidelines as our target and measure our work against them. It does not mean every part of the Site fully meets every criterion at all times. Where we fall short, we treat it as something to fix.

Measures we take

To work toward our conformance target, we take measures that include the following:

  • Using semantic HTML and a logical heading and landmark structure, so that assistive technologies can interpret page content and navigation in a meaningful order.
  • Supporting keyboard operability, so that interactive elements — links, buttons, and form fields, including those in the scouting application — can be reached and used without a mouse, with a visible focus indicator.
  • Working toward sufficient color contrast between text and its background so that content is easier to read for people with low vision.
  • Providing text alternatives for meaningful images and other non-text content, and labeling form fields so their purpose is clear.
  • Respecting the operating-system “reduced motion” preference, so that animations and motion effects are minimized for people who have asked their device to limit them.
  • Carrying out ongoing automated and manual testing, including review with keyboard navigation and assistive technology, and folding accessibility checks into how we ship changes.

Known limitations and ongoing remediation

Despite our efforts, some content on the Site may not yet fully conform to WCAG 2.1 Level AA. Accessibility can be affected by third-party components, embedded media, documents, and content that changes over time. We are not aware of barriers that prevent the core experience from being used, but we know there is more to do.

When we identify an accessibility issue — whether through our own testing or through feedback — we work to fix it as part of our ongoing remediation, and we prioritize problems that affect people’s ability to use core features such as the scouting application.

Scouting Safety & Anti-Impersonation

Your safety matters to us. Many people who apply to Our Scouting program are between the ages of 14 and 17, and applicants share photos and personal details as part of an application. Because of that, we want to be completely clear about how Theodyx really operates, how to recognize and avoid impersonation and scams, and how to reach us if anything ever feels wrong. Please read this notice carefully, and if you are a parent or guardian, please read it alongside the young person applying.

How Theodyx really operates

Knowing how we work makes it much easier to spot anyone pretending to be us. These are firm rules we hold ourselves to, every time:

  • We contact applicants only from official @theodyx email addresses. Genuine messages from us come from an address ending in @theodyx.com (for example, our scouting team writes from scouting@theodyx.com). If a message claims to be from Theodyx but comes from a personal email, a free webmail account, or any address that does not end in @theodyx.com, it is not from us.
  • We never charge a fee to apply. Applying to Our Scouting is free. There is no application fee, no registration fee, and no “processing” cost of any kind.
  • We never ask for payment, banking, or financial information. We will not ask you to send money, buy gift cards, pay for a “portfolio” or “training,” or share bank details, card numbers, or other financial information as part of applying or being considered.
  • We never request nude, lingerie, or otherwise sexualized or inappropriate photos. The only images we ask for are ordinary sample photos and an optional media kit, submitted through the application form. Anyone asking for revealing, suggestive, or inappropriate images is not Theodyx, and you should stop and report it.
  • We do not move minors to private or off-platform chats, and we do not ask for personal contact details. We will not ask a young person to continue a conversation in a private direct message, a personal messaging app, or a personal phone number, and we will not pressure anyone to keep communications secret from a parent or guardian.

For parents and guardians

If the person applying is a minor, we strongly encourage you to be involved. We welcome a parent or guardian taking part in the application and in any communications that follow. A good rule of thumb: a young person should never be asked to handle money, share financial details, send private images, or move a conversation off official channels — and if any of that happens, a trusted adult should be looped in right away.

We also encourage families to talk through this notice together before applying, so everyone knows what a real message from us looks like and what a scam looks like.

Red flags of impersonation and scams

Scammers sometimes pose as talent scouts or agencies to pressure young people or take their money. Treat any of the following as a warning sign that a message is not genuinely from Theodyx:

  • A request to send money, pay a fee, buy gift cards, or share bank or card details.
  • A request for nude, lingerie, suggestive, or otherwise inappropriate photos — or for images beyond ordinary sample photos.
  • A push to move the conversation to a private or off-platform chat, a personal phone number, or a personal messaging app.
  • A request for personal contact details, or pressure to keep the conversation secret from a parent or guardian.
  • Messages from an email address that does not end in @theodyx.com, or that imitate our name with a slightly different spelling or domain.
  • A sense of urgency or pressure — “act now,” “this offer expires today,” or threats that an opportunity will be lost unless you respond immediately.
  • Promises that sound too good to be true, such as guaranteed fame, guaranteed payment, or a contract before any genuine review.

If you see one or more of these signs, do not send money, images, or personal information. Pause, and verify before you respond.

How to verify a message is really from Theodyx

If you receive a message that claims to be from us and you are not sure, here is how to check:

  • Check the sender’s full email address, not just the display name. It should end in @theodyx.com. Look carefully for misspellings or look-alike domains.
  • Remember our firm rules. We never charge a fee, never ask for payment or financial information, and never request inappropriate photos. Any message that does is not from us.
  • When in doubt, ask us directly. Email scouting@theodyx.com and we will confirm whether a message genuinely came from Theodyx before you take any action.

How to report impersonation or anything that feels wrong

If someone is impersonating Theodyx, or if any message or request makes you uncomfortable, please tell us. Email scouting@theodyx.com with as much detail as you can — the sender’s email address, screenshots, and what they asked for. Your report helps us protect you and other applicants. If you ever feel you are in immediate danger, contact your local emergency services first.

How we protect minors’ information

We take particular care with information about young people. Photos and full-length images of minors are treated as sensitive personal information: we minimize what we collect, restrict who can access it, and never sell or share it for cross-context behavioral advertising.
